The main content of the course deals with elements of Virginia Law affecting the exchange of real property. The course outlines the different ways an owner of property can both acquire and transfer title as well as the legal components of such transfers. The course will also review the various contract disclosure statutes as well as relevant legislative changes. This course will also bring legal updates through current case law examples. Real Estate Professionals will be able to use this information as a useful guide when assisting their clients.

This course examines the increasingly important issues presented by Section 8 of RESPA – the famous anti-kickback and affiliated business arrangement provisions of the statute. An avalanche of enforcement actions and an increasingly sophisticated array of business arrangements aimed at avoiding the strictures of Section 8 have highlighted HUD’s changing attitudes about Section 8 recently. Many of these actions directly affect real estate firms, their owners, their joint venture partners and their agents.

This course will explore the phenomenon of the limited service broker and the ways in which this new competitive model affects the practice of real estate. The focus will be on the differences in the levels of service and representation offered by the limited service broker and what selling agents should expect in dealing with sellers who are so represented. We include agency, compensation, ethical and antitrust concerns in an effort to allow the selling agent to better serve their buyer clients and customers in dealing with limited service brokers.
